A schedule of dilapidations is a report documenting damages to a property and costs of repair works required to restore the property to the condition it was in at the start of the lease. Typically presented by the landlord to the tenant towards the end of the lease term, it can sometimes come as an unexpected surprise.
A schedule of dilapidations can be served either during the lease term (Interim Schedule of Dilapidation) towards the end of the lease term (Terminal Schedule of Dilapidation) or even shortly after the lease ends.
Usually, a dilapidations claim is brought towards the end of the lease.
A Schedule of Dilapidations can also be brought during the continuation of the lease. This is known as an interim Schedule of Dilapidations. This is however a more complicated process as there are statutory requirements which govern the process.
Landlords and tenants are expected to follow Dilapidations Protocol, a set of Civil Court Rules that govern the conduct of terminal dilapidations claims. A failure to comply may result in costs sanctions against the non-compliant party.
Whoever instructs the surveyor to draw up the dilapidations report is responsible for the payment.
The cost depends on the whether you are the landlord or tenant, the property’s size, type, and the complexity of the lease arrangements. A tenant has up to 56 days to respond to a dilapidations claim – from the date that the claim is served.
A tenant can only do repair work while their lease continues unless otherwise agreed with the landlord.
A Scott Schedule is a Schedule of Dilapidations with additional columns to enable the parties to set out their respective views. The document is usually prepared by a building surveyor.
